“Administrative Measure on the Control of Pollution Caused by Electronic Information Products” (hereinafter abbreviated as “Administrative Measure” or “China RoHS”) is published at March 2, 2006 and has come into force in March 1, 2007.

Administrative Measure is a Ministry regulation of the State Council, and jointly promulgated as a Minister order by Ministry of Information Industry (MII), National Development and Reform Commission, Ministry of Commerce, General Administration of Customs, State Administration for Industry and Commerce, General Administration of Quality Supervision, Inspection and Quarantine, State Environmental Protection Administration. The Administrative Measure is hereby developed to restrict or eliminate the toxic and hazardous substances or elements used in electronic products during the research, design, production, importation, and sales processes, such as lead, Mercury, Cadmium, Hexavalent chromium, Polybrominated biphenyl (PBB), Polybrominated diphenyl ether (PBDE).

Scope
Administrative Measure shall apply control and reduction of pollution and other public hazards to the environment caused during the production, sale, and import of electronic information products in the People’s Republic of China. However, the measure shall not apply to the production of products destined for export. The administrated products are indicated on “Note for Classification of Electronic Information Products” definitely.

Enforcing Process
”Administrative Measure” adopts the “Two-step approach” method.

The first step:
From March 1, 2007, the effective date of the Administrative Measure, manufacturers are required to expose (indicate) related environment-friendly information by self-declaration for those electronic information products entering into the market. There is no “substituted” or “restricted” requirement about the toxic and hazardous substances and elements which electronic information products contained at first step. The products should be estimated by or identical with three standards which further defining the requirements of the administrative measure. The three standards have been issued on 6 November, 2006.

The three standards are:

  • SJ/T 11363-2006
    “Requirements for Concentration Limits for Certain Hazardous Substances in Electronic Information Products”
  • SJ/T 11364-2006
    “Marking for Control of Pollution Caused by Electronic Information Products”
  • SJ/T 11365-2006
    “Testing Methods for Hazardous Substances in Electronic Information Products”

The second step:
The Ministry of Information Industry shall prepare and revise the “Key Catalogue for the control of Pollution caused by electronic information products” (hereinafter abbreviated as “Key Catalogue”) in consultation with the other six Ministries. At first, the Key Catalogue is empty. Then according to technological and economic actual conditions, some products will be listed in Key Catalogue. The electronic information products entering into the market, which are listed in the Key Catalogue, must reach the requirements of either substituting toxic and hazardous substances or meeting the limit(s) set by the standard(s). Then manufacturers obtain compulsory certification (3C certification) to enter into the market.
